Dear 998 Members,
This past month, the Wisconsin Assembly passed a bill that would require local mass transit employees to provide proof of physical fitness as a condition of employment. The bill, AB736, would also prohibit collective bargaining over this issue. Our statewide Legislative Conference Board sees this as a direct violation of 49 U.S.C. sub.5333(b), or Section 13 (c) of the Urban Mass Transit Act.
The State Senate is expected to act on this bill sometime in March, 2016.
While no one disputes the merits of this bill as to how it pertains to the overall safety of our drivers and the public, the fact that it would not be a collective bargaining issue is troublesome. Dan Kane and Dale Anderson of our Legislative Conference Board have found that no other state in the country prohibits its municipal employees from bargaining collectively over the requirement to provide proof of physical fitness.
This is why we need you to call on members of the State Transportation Committee and tell them that Federal dollars may be at stake, and although we agree on the need for the safest roads possible, it should not come at the expense of collective bargaining rights.
